I have two personal goals here:
1) Acquire more key evidence to use in Danny Hicks's petition for post-conviction relief due by October 12th, 2010.
Danny, 61, is the guy who gives the shirt off his back to anyone. Until the incident on 12/14/08, this correctional officer had NO criminal record. His crime: he pointed a gun at a stranger in his house and ordered him to leave shortly after learning he had been robbed blind of most of his life savings.
The man left, no one was hurt. But the thieves worked a fraudulent county court system and, on 7/17/2009, imprisoned Danny in protective segregation for 3.5 years. Since then, this crime family has robbed him of nearly everything he had left. This is an effort to catch them as they attempt to defraud the government and steal a house.2) Ensure that Danny doesn't walk out of prison to find that he has nothing left. This means to preserve his rights, lawsuits, and any other means of restitution available to him, so ensure he has a home when this is finished... and then some.
Theresa Wirth and her family have over 30 years of fraudulent schemes under their belts with many of them still ongoing.
As time is of the essence, I focus on the impending theft of the property at 5701 E El Camino Quinto, Apache Junction, AZ.
The victims are both Danny Hicks and the American taxpayers. This is a case of defrauding the U.S. Department of Housing and Urban Development.

EXECUTIVE SUMMARY
Here's the HUD Property Condition Report dated 7/7/2010. The report notes some of the equity that was stripped by Theresa Wirth, a felony in Arizona, and also notes the failed plumbing and electrical tests. Wirth rigged the house before moving to ensure those tests would fail. Thus, the house valuation is low as a result of the facade created by Wirth, who I believe intends to purchase the house at this superficially deflated price. Evidence and logic strongly suggest that they will make their bid for the house before midnight Sunday, August 29th, 2010 when HUD's 10-day initial bidding period ends.
The house is in much better condition than the HUD report suggests. The plumbing and electrical systems have been rigged to ensure their failure when inspectors performed their tests. Both systems work fine. Damage that appears to be a large job for a prospective buyer, is actually a small job for the crooks who have the pieces of the puzzle to drop back into place. The equity that's been stripped from the house is a mere 2.5 miles up the road, in plain sight, staged and ready to be moved back once the thieves steal the property at a fraction of its true value. This crime family is Theresa Wirth, her brother, Jeffrey Lanpher (aka William Lanpher, aka Guy Hiraeth) and their mother Juanita Morley, who lives just across the street at 5700 E El Camino Quinto.
The house was sold to Danny Hicks in June 2008 for $240K, where he started a dog breeding business with Theresa Wirth, unaware of her plan to milk him of everything he owned, including his line of credit, and then plant him in prison while they finished him off.
Including several crimes that have already been committed, if this fraudulent scheme happens, the violations of state and federal law will include:
- mortgage fraud
- defrauding a secured creditor
- criminal damage
- equity stripping (house stripping, a felony in the State of Arizona)
- forgery
- defrauding the Federal Housing Authority and the state and federal government
Other recent closely-related crimes of which I have strong evidence:
- fraudulent Medicare and Medicaid claims
- identity theft
- credit/debit card fraud
- tax evasion
- breaking / entering and burglary
- extortion
- bigamy
The list goes on, as do the number of criminals involved, but the remaining offenses must be considered in the context of the petition for post-conviction relief to be completed before October 12th.
Again, the most important consideration for me: How to best preserve Danny's rights to any restitution that might be available to him? Everything's bee stolen from him and I plan to ensure that he does not walk out of that prison to find he has nothing left.
I need the right investigator. It is quite possible that someone within HUD may be part of Wirth's plan, so this should be kept in mind. Wirth and her family have been involved in the real estate fraud game for nearly 30 years. They have contacts.

I've spoken with Pinal county officers, and have even managed to get one of them to issue this report. Pinal county property detectives have been of no real help.
If a specific contact isn't possible with such short notice, some guidance as to what agency I should trust as far as reporting this crime would be deeply appreciated. I understand... that might be more difficult than finding a "real" contact...;-)
Whatever happens, keep an eye out... cause I'm goin in!
Thanks for listening and for being so solid on the front lines, Shahid. I admire your work.
And I especially admire the tracks you did with Adam hosted on SoundCloud...;-)

Here's a brief time-line leading up to this moment, including hyper-links to some of the key pieces of evidence.
7/29/2008
Wirth and her mother steal Danny's two Labrador retrievers - his two best friends. An FOIA request says Wirth's story claiming they gave his dogs to the airforce is false.
12/14/2008
Danny Hicks is incarcerated - a setup by Wirth. Wirth continues to live in the home.
6/18/2009
Wirth and family attempt to extort the house from Danny.
7/17/2009
Danny refuses to sign over the house. Wirth gives unsworn testimony pursuant to Arizona's victim's rights law and the judge rejects the prosecutor's offer of probation and sentences Danny to 3.5 years.
9/29/2009
Wirth and family begin extortion attempt #2. Leveraging a false claim that the judge will order $10,000 in restitution, they threaten to abandon Danny's home and to proceed with a lawsuit if he refuses to sign over the house.
10/15/2009
Foreclosure attorney Thomas Koniuszy mails extortion documents to Danny in prison. Danny mails the documents to us and never responds to Koniuszy or Wirth.
11/10/2009
Koniuszy sends a letter retracting the extortion attempt.
12/28/2009
Wirth and family begin to strip the house of all of Danny's belongings - ~$40K - $50K in house furnishings and appliances. They also strip the house of most of the remodeling investments and the dog kennels Danny built over the course of several months before his arrest. All together, Danny had spent all of the $85K loan he took against his trailer in Queen Valley. He also sold most of what he owned including his Harley, his truck, two ATVs, and a boat.
3/30/2010
Wirth strips the house as the foreclosure auction approaches, moving everything 2.5 miles up the road to 3351 S. Silly Mountain Road, Apache Junction where it sits at this very moment, much of it in plain view.
6/2/2010
The property becomes Real Estate Owned property after the Sheriff's auction fails to solicit any bids. Not unexpected in light of Arizona's flood of foreclosures. Bank of America dba Countrywide Home Loan Services had put the property up for auction at ~$240K.
7/7/2010
Secretary of HUD assumes ownership of the property upon issuing BofA an undisclosed FHA loan amount.
8/5/2010
HUD Inspection Report is issued noting several issues: missing appliances - water heater, garbage disposal, washer and dryer, wood-iron gates, all indoor and outdoor lighting fixtures, etc. - failed plumbing test, failed electrical tests, etc.
8/20/2010
HUD SALE: 5701 E El Camino Quinto, Apache Junction, AZ is listed for $95K.
Bidding restricted to owner-occupying bidders until 8/29/2010 at 11:59pm.
I have all the necessary evidence, and I can show investigators where the stolen equity is located at this very moment. The custom-made, wood-iron gates are key - ~$1800, custom built for the block wall at 5701, I have Danny's canceled checks and I've spoken to the contractor who built the wall and gates for him. The lighting fixtures, lamp post, mailbox, and kennels are also in plain view. I have durable Power of Attorney authority to act on Danny's behalf, and I have access to the evidence in his financial records.
I have to say this once more, because the injustice screams at me to make it known...
Danny, 61, had a spotless record until this incident. He worked for the Arizona DOC right up until he resigned in December 2008 as a result of the incident. He's now withering away in protective segregation in the same prison where he once worked. He feels ashamed for not being able to help assist in his own defense. Two brand new college text books on law that I had delivered directly from Barnes and Noble were intercepted by the prison and confiscated as contraband. The other "victim" in this case - William Porter - a Pinal County Detention Officer at the time - ensured Danny was moved constantly throughout the jail system, each time, his case file and medication for high-blood pressure taken from him. It took me 8 months to get his case file out of the hands of the crook they call the Public Defender, Mary Wisdom, and over a year to finally convince the court-appointed petition attorney that he best request the judge to step him down to advisory counsel and let Danny and I proceed pro se. Danny pointed his gun at William Porter - a stranger in his house - and told him to "Get out!" upon discovering a few hours earlier that he was being robbed him blind.
The case had nothing to do with Danny, however. The county attorney defrauded the grand jury in an attempt to cover-up the botched cover-up of William Porter's attempted murder of Danny Hicks... But that's another story...
